Contingency Fee Agreement โ No Recovery, No Fee

Client hereby retains Recovery Agent to pursue the recovery of surplus funds held by the applicable Arizona county treasurer's office resulting from a tax foreclosure sale of property previously owned by Client (the "Surplus Funds").
Recovery Agent agrees to provide the following services on behalf of Client:
(a) Research and verify the existence and amount of Surplus Funds owed to Client;
(b) Prepare, file, and submit all necessary claims, petitions, and documentation to the applicable county treasurer's office;
(c) Communicate and coordinate with county officials regarding the claim;
(d) Take all reasonable steps necessary to secure the release of Surplus Funds to Client.
Recovery Agent's fee shall be a flat fee of $2,500 as permitted by A.R.S. ยง 33-812(P) of the total Surplus Funds recovered. This fee is payable ONLY upon successful recovery of funds. If no funds are recovered, Client owes nothing.
(a) The fee shall be deducted from the recovered Surplus Funds before disbursement to Client.
(b) Client shall receive eighty percent (80%) of all recovered Surplus Funds.
(c) There are no upfront costs, retainer fees, or other charges to Client.
Client agrees to:
(a) Provide accurate and complete information regarding the foreclosed property and their ownership;
(b) Execute any documents reasonably required to process the surplus funds claim;
(c) Provide valid identification and proof of former ownership as needed;
(d) Respond to communications from Recovery Agent in a timely manner.
(a) This Agreement shall remain in effect until the Surplus Funds are recovered or the claim is denied with no further appeal available.
(b) Either party may terminate this Agreement with 30 days written notice.
(c) If Client terminates after Recovery Agent has filed a claim, and funds are subsequently recovered, the $2,500 fee shall still apply.
Recovery Agent makes no guarantee that Surplus Funds will be recovered. Recovery depends on county processes, claim validity, and applicable deadlines. However, Recovery Agent will use commercially reasonable efforts to pursue the claim.
This Agreement shall be governed by the laws of the State of Arizona.
